Lemansky was cited about 4:30 p.m. Monday at a home where she was visiting friends, Cary Police Capt. Randall Rhyne said. She told police her residence is in South Daytona.

Lemansky had her two dogs with her, and animal control officers said the dog who had been duct-taped - Brown - did not show signs of hair loss where the tape had been. Officers said both dogs were well cared for and Lemansky was allowed to keep them with her.

Backlash over the photo was overwhelming in Florida.

South Daytona Police Department Chief Ron Wright said the overwhelming response slowed down their investigation.
