Will Smith's blood alcohol level was three times the legal limit when the former Saints defensive end was shot and killed during a confrontation in April, according to The Times-Picayune.

Smith's toxicology results indicate he had .24 percent blood alcohol content, according to the Times-Picayune. Louisiana's legal limit is .08.

Cardell Hayes was charged with second-degree murder in the incident after police said he fired multiple, fatal shots at Smith after he rear-ended Smith's SUV April 9 in the Lower Garden District. A court hearing for Hayes is Wednesday.

 Hayes' attorneys said their client fired his gun in self defense and is "legally not guilty" of the charges, according to the Times-Picayune.
