The Milton City Council recently plugged a loophole in its development ordinances that allowed homes to be built on smaller lot sizes than anticipated because of confusion over the definition of paved versus unpaved roads.
Milton has 12 miles of unpaved or gravel roads. Its ordinances require minimum lot sizes of three acres if a subdivision fronts an unpaved road, and one acre if it faces a paved road.
However, some projects considered by the city last year had small extensions of pavement in their gravel roads, and they were approved for one-acre lots. The Council last fall adopted an emergency moratorium through Feb. 7 on applications for zoning and development permits while the city dealt with the issue.
On Monday, the Council amended its ordinances to ensure any tract fronting an unpaved road would have a minimum lot size of three acres. A list of the 30 unpaved roads in Milton was attached to the amendments.
