Gwinnett County Superior Court Judge K. Dawson Jackson refused to issue an injunction barring Gwinnett County Public Schools and the Georgia School Boards Association from participating what has been described as illegally using taxpayer resources to campaign against the charter schools amendment.

Jackson wrote that the school district and GSBA were exercising their freedom of speech rights in opposing the amendment.

The judge’s ruling is the second time this month that an effort to stop a school district from speaking out against the amendment has been shot down.

A Fulton County Superior Court judge ruled against a similar injunction request filed against the Fulton County School District.

Some residents in Fulton and Gwinnett have complained that school superintendents, school board members and the GSBA have violated state law by actively opposing the amendment on taxpayer time.

Opponents of the amendment said the injunction requests were an attempt to squash opposition.
