A Fulton County sheriff’s deputy arrested and later fired for illegally running a nightclub is asking to get his job back because he says he was not engaged in “conduct unbecoming” while on duty.
Devon Brown wants the Fulton County Superior Court to overturn a Fulton County Personnel Board decision that upheld his dismissal from the department.
Brown, who worked for the department since 1995, was placed on personal leave after being arrested in February 2014 and charged with illegally running a nightclub during what police said was a routine "compliance check" at the club along Metropolitan Parkway.
Police said they found windows and doors covered when they went to the club and they smelled “the keen odor of burning marijuana,” according to the officer filing a report on the incident.
About 15 to 20 patrons were drinking alcohol, police said.
As police entered the building, they saw four or five nude women running into the back of the club, according to the report. They also found a man and woman having sex, authorities said.
Brown told police that the club was private and that he had been told years ago that he didn’t need a license. But he could not produce the charter or roster required for a private club.
He also could not produce an alcohol license, an up-to-date permit for his coin-operated billiard table or a food service permit.
Police said Brown had been warned two months before about the need to obtain permits and licenses and that the investigator who warned him was on the scene.
