Q: Can executive orders be overturned by the Congress? What controls are there to keep an out-of-control president from causing havoc?
— Anita Johnson, Smyrna
A: Congress can overturn a presidential executive order if it is based on a power delegated to the president by Congress, Gerhard Peters, the co-director of the American Presidency Project at the University of California Santa Barbara, told Q&A on the News in an email. "Obviously, the president may veto the congressional action, so Congress would probably need the two-thirds vote in each chamber to override the veto," Peters wrote. Congress is less likely to challenge executive orders that pertain to foreign policy, national defense or treaties, since these powers are granted largely to the president by the Constitution, according to ThisNation.com, a website about the U.S. government. Executive orders have been used by every president, but many of them were seen only by the agencies involved, according to the website.
