Attorney Kevin Tallant filed a petition with the Georgia Court of Appeals Wednesday on behalf of the Snellville City Council. The appeal is asking the court to reconsider the Gwinnett Superior Court’s ruling in favor of Snellville Mayor Kerry Kautz regarding repayment of legal fees.

Judge Warren Davis ruled in April the city will have to pay the mayor’s three-attorney team approximately $88,000 to cover expenses incurred from the mayor’s 2014 lawsuit against the city council. The city has already agreed to pay City Attorney Tony Powell’s $115,000 fee for defending the council.

Kautz had argued in court her legal fees should be reimbursed since the lawsuit ended in a settlement with both sides claiming victories.

The Court of Appeals will hear arguments in September.
