Roswell has agreed to pay the Martin’s Landing Foundation $500,000 to settle a dispute over the upkeep of Martin’s Lake and North Pond.

Martin's Landing is a community of 1,030 acres and 1,964 single- and multi-family homes in 12 subdivisions developed in the 1970s. According to a settlement agreement approved by the Roswell City Council, the foundation had spent more than $4.5 million on its lakes and was at odds with Roswell, under the city's Lakes and Ponds Partnership Policy, regarding the costs of dredging and other actions.

To avoid litigation and without admitting liability, the agreement says, Roswell will pay $500,000, and the foundation will release the city “from any and all claims for erosion, sedimentation and applications for the projects in existence before the date of this agreement.”

Martin’s Landing Foundation will let Roswell use the lake and pond as part of its stormwater management system, and grant an easement allowing city personnel access to inspect the bodies of water and perform emergency work, if necessary.
