Johns Creek will use its eminent domain power to acquire rights of way and easements for Ga. 120/Abbotts Bridge Road improvements from two homeowners associations along the route.

The city has reached agreements with the Abbotts Bridge Place and Communities of Wellington homeowners associations, but their covenants and restrictions require written approvals of two-thirds of the owners and two-thirds of first mortgagees to execute them, according to a staff report to the City Council.

“In light of this onerous requirement,” the associations have consented to the city’s use of its eminent domain power, staff said.

The council approved paying $10,759 to Abbotts Bridge Place for 4,123 square feet of right of way, 361 square feet of permanent easement, and 6,926 square feet of temporary driveway easement; and $124,700 to the Communities of Wellington for 3,488 square feet of right of way and 5,597 square feet of permanent easement.

The Abbotts Bridge project extends from Parsons Road to Primrose Parkway.
