Two property owners will have a little less property due to a May 28 decision by the Cobb County Board of Commissioners.
For the Old 41 Highway Bridge over the CSX Railroad, Fairburn Town and Country Apartments, 1161 Bells Ferry Road, Marietta and Kennesaw Mountain Business Park, 1330 Old Highway 41, Marietta will have small portions taken for driveway easement, temporary and permanent construction easements and right-of-way.
This joint project with the city of Marietta will be funded by the 2016 Special Purpose Local Option Sales Tax.
The project consists of a complete bridge replacement of the existing bridge on Old 41 Highway over the CSX Railroad near the intersection of Bells Ferry Road.
Since additional rights-of-way and easements are needed to construct this project, to ensure project deadlines are met, the Cobb Department of Transportation requested condemnation approval by the Board of Commissioners in case negotiations are unsuccessful with the two property owners.
