A Sheriff's Office spokesperson said the dachshund mix was cold, malnourished and possibly had a concussion, according to KTVI-TV. Temperatures in the area the night before the animal was found dipped into the teens.

The good news is the animal, nicknamed Jimmy by its rescuers, is doing better, and investigators made an arrest in the case.

They were able to find a finger print on the duct tape that led them to Paul Garcia, the news station reported.

Garcia, 39, was taken into custody and charged with animal abuse and armed criminal action, according to KTVI. Garcia is jailed on a $50,000 bond.

It’s still unclear if Garcia owned the dog or if others may be involved. The sheriff is still asking for the public’s help in gathering more information in the case.
