An 8-year-old boy was hit by a vehicle outside an Atlanta elementary school Wednesday, police said.

The boy was alert and said his leg hurt after a vehicle struck him outside Slater Elementary School, Atlanta police spokeswoman Officer Stephanie Brown said.

The driver was not charged in the incident because a crossing guard had not yet raised the stop sign for the children to cross and the driver had a yellow light, according to a police report.

The child’s parent was with him when he was struck.
