Looks like Chris Brown has managed to avoid jail time once again.

The Los Angeles Times reports a judge turned down the prosecutor's motion to put Breezy behind bars Monday because of his arrest on an assault charge in Washington, D.C. last year.

According to TMZ, the prosecution wants Brown in jail immediately because his "violent behavior continues to increase in severity and frequency."

But the judge disagreed.

He said, instead of jail, Brown should stay in rehab because he seems to be showing signs of progress. For now, he has ordered the singer to remain at the treatment facility. (Via RCA Records / Chris Brown)

Brown made headlines when he was first sentenced to rehab back in November. He was ordered to get treatment for substance abuse and anger management after he allegedly punched a man in the face outside a D.C. hotel. (Via Hollywood LifeTMZEntertainment Tonight)

He has pleaded not guilty to misdemeanor assault in the D.C. case and refused to take a plea deal that would reduce the charge to simple assault. (Via American Music Awards)

Brown is scheduled to appear in court for another hearing Feb. 28.
