Rather than risk a jury trial scheduled for January, the Sandy Springs City Council has opted to pay $465,000 to acquire property and settle all claims regarding land needed for the Sandy Springs Circle Streetscape project.
The council approved the settlement of pending condemnation action at 6025 Sandy Springs Circle, a strip shopping center, over 0.096 acres of fee simple right of way and 0.056 acres of temporary easement.
“After much discussion, the property owner, W.A.G. Sandy Springs Properties LLC., has proffered an offer to settle this matter in the amount of $465,000,” City Attorney Dan Lee said in a report to the council. “This includes the fee simple right-of-way, necessary easements to complete the project, and consequential damages and cost to cure issues.”
The property owner will be paid $280,400 from funds paid into the Court Registry at the time of the taking, and the city will make an additional payment of $184,600 directly to the owner, Lee said.
