The Henry County Board of Commissioners approved at its Dec. 16 meeting a resolution asking the county’s legislative delegation to “submit legislation clarifying the authority of the Board of Commissioners, the county manager and the chairperson.”

The resolution was approved by a 5-1 vote with chairman Tommy Smith voting against.

This is in response to a November court filing by Smith alleging that “there is uncertainty as to the exercise of the authority and duties delegated to him by the General Assembly” and that his authority “has been largely usurped by the Board of Commissioners illegally and in an unconstitutional manner.”

Commissioner Brian Preston, who introduced the resolution, said Smith has made the issue personal and he wants personal agendas taken out of it. Preston added that the legislature can handle it more quickly and cost-efficiently than the judicial system.
