Man injured in ATV accident has died, teen may face charges

A man who was injured in an all-terrain vehicle accident Monday night has died.
 
  Nickolas Eugene Sellers, 32, of Carrollton, was ejected from the Suzuki ATV and killed when he struck a utility pole on Sage Drive in Carrollton, police said.

Blake White, 13, the son of Seller's girlfriend, was driving the ATV, according to police. He remains in the intensive care unit at Children's Health Care of Atlanta at Egleston with broken ribs, fractured wrists and major cuts and bruises, according to his father, Michael White.

The crash remains under investigation and police are considering filing charges against the teen for operating the ATV without a license and on a public roadway, which is illegal in Georgia.
 The case has been turned over to the Soliciter General's Office to see what course of action to take, said Lt. Paul Cosper of the Georgia State Patrol.

Blake White's father says his son should not face any charges in the accident.

"My heart sank I heard they were even considering charging my son," said White. "This accident is traumatizing enough for him at his age."
