The son of a former Atlanta high school principal has been indicted for allegedly collecting more than $50,000 of his father's retirement benefits after his death.
Eugene B. Wimby Jr., son of former East Atlanta High School principal Eugene B. Wimby, was indicted Friday by a Fulton County grand jury on 14 counts of theft by taking.
The indictment alleges that the younger Wimby, who had been given power of attorney by his father, failed to disclose Wimby's death on Sept. 26, 2008 to the Teacher Retirement System of Georgia.
From October 2008 through November 2009, the indictment alleges, Wimby Jr. illegally transferred or withdrew $53,525 in retirement funds from his father's checking account. The TRS stopped making payments when it discovered the elder Wimby's death through a mortality report.
If convicted, Wimby could be sentenced to 10 years in prison and fined $100,000 for each count.
