A Cobb County judge will consider today if a former Kennesaw State University student who sparked a national debate when she was nearly deported last year should enter a pretrial diversion program.

District Attorney Pat Head, whose office administers the program, accepted Jessica Colotl into it last month. Participating would allow Colotl, a 23-year-old Mexico native, to avoid a criminal conviction for felony false swearing for allegedly lying to deputies about her address when they booked her into jail for driving without a license.

Cobb County Superior Court Judge Mary Staley noted in her order that Head apparently did not consult Sheriff Neil Warren about the decision. Warren and Head were ordered to appear along with Colotl.  ANDRIA SIMMONS
