A man who made national headlines in December for allegedly kidnapping his two sons and taking them to Texas is facing new charges, Suwanee police said Tuesday.
Daniel Cleary, of Roswell, was arrested Monday night and charged with aggravated stalking, DUI, fleeing/attempting to elude, speeding and reckless driving for a string of events that ended when he was stunned with a Taser, according to Capt. Shane Edmisten.
It began around 7:45 p.m. Monday as a report of a “suspicious person” with a knife seen behind a home in a neighborhood off Peachtree Industrial Boulevard, Edmisten said. The person turned out to Cleary, who was out on bond following his December arrest, according to police.
As a condition of Cleary’s bond, he was not allowed to see his sons nor be within 10 miles of their mother’s Suwanee home, Edmisten said. When officers spotted Cleary’s PT Cruiser, they attempted to stop him, but Cleary drove southbound on Peachtree Industrial into the Duluth city limits, police said.
Cleary crossed a median and turned back north to avoid Duluth officers’ attempt to stop him at the intersection of Ga. 120, Edmisten said. That’s when a Georgia State Patrol trooper began pursuing the Cruiser and used a maneuver to stop the vehicle, he said.
“The suspect exited his vehicle with a knife to his throat,” Edmisten said in an emailed statement. “When Cleary failed to comply with officers’ commands, a Suwanee police officer deployed his Taser, thus incapacitating Cleary and preventing him from harming himself.”
The police pursuit temporarily blocked Peachtree Industrial in both directions late Monday.
Cleary was arrested and booked into the Gwinnett County jail, where he remained Tuesday night without bond.
In December, Cleary was accused of failing to return his sons to their mother, launching an intense search for the boys. After being spotted at a Tennessee Walmart, the boys were found unharmed in an Austin hotel with Cleary, who was arrested.
