Man accused of shooting at Gainesville officers now faces attempted murder charge

A Gainesville man accused of shooting at police outside an extended stay motel now faces an attempted murder charge, authorities said Tuesday.

Daniel Andrew Smith, 37, was arrested June 25 after allegedly opening fire on officers outside the hotel on Jesse Jewell Parkway.

Gainesville police responded to the scene about 10:30 p.m. after receiving a call about a man with a gun drinking alcohol outside, AJC.com previously reported.

“As officers attempted to make contact, the subject immediately produced a firearm and began firing,” Gainesville police said.

One officer fired back, and Smith ran behind the motel. He was taken into custody about five minutes after police arrived, authorities said. No one was injured in the exchange of gunfire.

Smith was charged with aggravated assault on a police officer. On Thursday, investigators added two additional charges, one for criminal attempt to commit murder and the other for possession of a firearm by a convicted felon, Hall County Sheriff’s Office spokesman Derreck Booth said.

Smith remains held at the Hall County Jail without bond, online records show.

The sheriff’s office is investigating the officer-involved shooting at the request of Gainesville police because the GBI was not available that night, authorities said. Hours earlier, agents were called to investigate the fatal shooting of a carjacking suspect in Cobb County.
