Man killed in Gwinnett; wife charged with murder

April 3, 2015

A man is dead and his wife is in jail on a murder charge after a shooting Thursday night at a Gwinnett County apartment complex.

Police said the shooting happened about 9:15 p.m. during a domestic dispute at the Preston Hill Apartments in the 2900 block of Buford Drive. Arriving officers were met by 36-year-old Olivia Annette Smith, who identified herself as the wife of the man found fatally shot inside the apartment, police said.

Smith was booked into the Gwinnett jail about 1 a.m. Friday, charged with murder and aggravated assault. Online records showed she was being held without bond.

Gwinnett police spokeswoman Cpl. Michele Pihera said Smith and the victim, 34-year-old Cory Smith, were married but had separated in mid-January following a pair of domestic disputes at their formerly shared home on Roxholly Walk in Buford. Cory Smith moved to the apartment where he was killed after a family violence order and divorce application were filed in January.

Pihera said that homicide investigators believe the couple was arguing when Olivia Smith produced a firearm and shot her husband.

“There is no indication at this point that there was a physical altercation between the two that led to a firearm being introduced,” Pihera said.

The previous domestic incidents were reported by Olivia Smith, police said, and she had been granted a protective order on Jan. 22. That order required that neither spouse have contact with the other.

The Smiths had two children together and a third from “a separate relationship,” Pihera said, adding that the Division of Family and Children Services was notified and will be involved in the placement of the children.
