Stockbridge city officials will be appealing to the Georgia Supreme Court after a Henry County Superior Court judge ruled against the city’s lawsuit to stop the referendum on the proposed city of Eagle’s Landing.
Stockbridge filed suit against the Henry County Board of Commissioners and the Henry County Board of Elections, the two governmental bodies with the legal authority to call for the referendum. This action came after the Georgia General Assembly earlier this year passed two bills paving the way for supporters of Eagle’s Landing to vote on whether to create a city.
Stockbridge officials alleged in their suit that the bills are unconstitutional. The legislation calls for only those voters in the affected area — which would potentially become the city of Eagle’s Landing — to participate in the referendum. That includes some voters now in the city of Stockbridge and others in unincorporated Henry County, but a large portion of Stockbridge voters would have no say in the matter, which is the basis of the city’s legal action.
