The Georgia Supreme Court on Monday ruled against two men who sought $5 million in damages from the Georgia Lottery Corporation in a trademark infringement dispute.
George Kyle and Frank Mankovitch said the lottery should have received their permission before using the “MONEYBAG$” logo on tickets printed in 2005 and 2007, from which the lottery made $5 million in gross profits, the ruling said. Kyle had obtained a registered trademark for the logo in 1995 and then gave Mankovitch the exclusive right to market the game. In a 4-3 ruling, the state Supreme Court rejected their claims.
