A 46-year-old man was shot and killed during a struggle over a gun with a Fairburn police officer Sunday, authorities said.

During the scuffle, the police officer deployed a Taser to get control of the situation, said James McCarthy, chief of police in the south Fulton city.

The chief said the death of Timothy Woods was not considered a police-involved shooting because the officer did not have possession of the gun. McCarthy told The Atlanta Journal-Constitution Tuesday Woods was shot with a “.38 special” around 10:45 p.m. Sunday in the 5200 block of Peachtree Landing Circle.

The Georgia Bureau of Investigation has been asked to review the case.

“The officer was trying to subdue one of the individuals and was in the process when the firearm went off. We don’t know the sequence of events so we got the GBI investigating,” McCarthy said.
