State investigators have slapped an Atlanta day care with an order for intended emergency closure.

The state's actions follow the rescue of a little boy from a hot day care van Monday.

The boy's grandmother and a good Samaritan found him dripping with sweat after being locked in the vehicle for hours.

Day care employee Shavonda Dailey, 29, was arrested Monday for leaving 2-year-old Jeremy Smith Jr. locked in the van for two hours.

That sparked an investigation into the New Beginning Learning Center on Sylvan Road.

Officials with the Georgia Department of Early Care and Learning say that the investigation found serious rule violations in the areas of transportation and supervision.

State investigators determined the day care was a danger to children.

New Beginning Learning Center has appealed the emergency closure, and by law, they can remain open until the hearing is scheduled.

Bright from the Start will determine the next steps against the provider.

"(Punishments range) from technical assistance and fines, all the way up to a restricted license, maybe even restricting all transportation," said Reg Griffin with DECAL.

A woman who works across the street told Channel 2's Tyisha Fernandes she doesn't know Dailey, but she knows the day care owner.

"Everybody who work over here and who live around here, most of their children go there," the woman said. "I'm surprised that the coworkers that she hired would do that, I'm shocked because that ain't never happened before, never."

The day care appealed the state's decision.

According to state investigators, the day care can remain open during the appeal process.

If your child goes to New Beginning, investigators can help you connect with other day care facilities in the area.
