Child molester Calvin McGee will ask the state Supreme Court on Monday to allow his lawsuit to go forward against former Fulton County Superior Court clerk Juanita Hicks and her assistant.

McGee is contending that negligence by the court clerk's office resulted in his being in prison for nearly two extra years and that he is due compensation

A  judge sentenced McGee to seven years in prison but in a later hearing reduced the time by 22 months. The clerk's office, however, didn't forward the order to the state Department of Corrections so McGee wasn't released on time.

Hicks and the assistant claim they have official immunity from the lawsuit, but the Georgia Court of Appeals ruled they did not. They're appealing that decision to the Supreme Court.

If they fail to persuade the court, McGee still will have to convince a jury he deserves to be compensated.
