Three Cherokee County residents are seeking a superior court injunction to halt a tentative deal for the lease/sale of the old Ball Ground recycling plant site-labeling it a “sweetheart” arrangement.
County commissioners and the Resource Recovery Development Authority last week agreed to accept a letter of interest from Cowart Mulch, which wants to lease/purchase the more than 30-acre tract over a 30-year period for $3 million.
Plaintiff Carolyn Cosby said the Cowart offer is down from $4.2 million in 2014 and said they want pending negotiations to finalize it stopped so the site can be sold to the highest and best bidder. The trio claims a sale of the land and equipment outright would fetch $10 million.
They said the Cowart deal is similar to the earlier arrangement the county made with recycling plant operator Jimmie Bobo, who declared bankruptcy and shut down in 2012. Commission chair L.B. “Buzz “ Ahrens, asked for comment by e-mail, and said only that “nothing surprises me with these folks.”
By late Tuesday, no hearing time/date had been set on the injunction request, said Cosby.
