The Samuel L. Jones Boys & Girls Club in Decatur has terminated its contract with Weaver Capital Partners to sell .6 acre, or about one-third of what’s currently a dog park. Developer Jay Weaver said Thursday he’s still mulling over his legal rights, adding that he probably has two choices: accepting the termination or suing both the club and the city. He said his attorney has advised against accepting the termination.

Weaver had planned to build two homes on the site, but on May 18 Decatur’s commission denied his project proposal. Weaver believes there’s a conflict of interest because the city wants to purchase the same property.

He said he also believes regardless of the city’s decision, the property can be developed – either as a subdivision or as two separate lots — because it’s been zoned residential since the 1940s.

Weaver said he has 30 days from May 18 to decide whether or not to sue.
