The Alpharetta City Council has approved signing a “Joint Defense Agreement” involving attorneys representing Fulton County and other Fulton cities including Atlanta in response to citizens’ class action lawsuits seeking property tax refunds.

The agreement essentially protects confidential communications among the parties and reduces duplication of costs, according to a staff report to the council. “Most of the parties have already approved (the agreement),” staff said.

The agreement involves Fulton; the cities of Alpharetta, Atlanta, Johns Creek, Milton, Roswell, Mountain Park, Sandy Springs, Chattahoochee Hills, East Point, College Park, Hapeville, South Fulton, Fairburn, Palmetto and Union City.

The suits at issue, according to the agreement, are Adam Rice and Devika Kumar et al v. Fulton County et al, challenging “illegally and erroneously” assessed taxes paid in 2016 and 2017, and Felicia Moore et al v. Fulton County et al, alleging erroneously based market value assessments in 2016.
