A Louisiana man identified as a suspect in an outburst at a Hall County gas station was captured Sunday, nearly one year after warrants were taken for his arrest.
An off-duty Hall County deputy happened to spot James David Fagan, 66, of Baton Rouge, at another gas station in neighboring Gwinnett County. The deputy was familiar with the 2018 case and recognized Fagan, according to a spokesman for Hall County Sheriff Gerald Couch.
“Investigative work, citizen tips, an observant off-duty deputy and the quick response of a neighboring agency were the perfect combination to lead to an arrest in this case,” Couch said in a statement.
Fagan is facing felony charges of terroristic threats and misdemeanor disorderly conduct in the July 1, 2018, incident at a gas station on Atlanta Highway in south Hall County.
He is accused of walking out of the convenience store, approaching a vehicle at the gas pumps and yelling at a man, woman and teenage girl inside. According to investigators, Fagan threatened to rape one of the vehicle’s occupants and kill them all.
The victims had no ties to Fagan, who left in a car following the incident, sheriff’s spokesman Derreck Booth said. He was later identified with the help of a tipster from surveillance photos the sheriff’s office posted to social media.
After the deputy spotted him and called 911, Gwinnett County police pulled over Fagan’s car on I-85. He was arrested without incident, according to the Hall County agency.
“This is a great example of how public safety is a team effort,” Couch said. “It takes each one of us to make our communities safer.”
Fagan is being held in the Hall County Jail without bond.
