Police say a 25-year-old accused of murdering a man during an attempted carjacking should have been in prison instead of shooting a father at a gas station.
Fulton County Police Chief Gary Stiles told Channel 2 Action News that Brian Duffy was already on probation for armed robbery when he allegedly shot and killed Kenneth Oglesby at a Chevron gas station on Thursday.
“Once again we have a young man who committed a heinous murder who should’ve been in prison,” Stiles told Channel 2.
Duffy was one of two men police believe pulled into the Roosevelt Highway station in a black Toyota Camry and tried to take a BMW SUV from Oglesby while at the pump.
Oglesby, 44, refused to give up his car, was shot once, ran to the store and collapsed inside. Police said the two suspects tried to get into the BMW but couldn’t start it and took off in the Camry.
Oglesby’s family members were outraged at the crime.
“This man was pumping gas; he has a son,” Cathy McDonald told Channel 2. “He has a family and you just going to come and shoot him like this?”
A Fulton officer spotted the Camry later Thursday evening and chased it down Fulton Industrial Boulevard. Duffy was pulled from the car, handcuffed and arrested.
Police on Friday were still looking for the second suspect from the shooting, Fulton police spokeswoman Cpl. Maureen Smith said.
