A Sandy Springs man accused of pushing his ex-wife off a balcony was arrested Monday, police said.

Mitchell Lott, 57, allegedly went to his ex-wife’s home Sunday, not long after bonding out of jail on charges related to a previous attack, Fulton County District Attorney Paul Howard told Channel 2 Action News.

Lott defied a court order to stay away from his 32-year-old former wife.

She had been sleeping with a hammer after two previous attacks by Lott, Howard said.

Lott broke into the Sandy Springs apartment they used to share, beat up his ex and, when she tried to fight back, he pushed her off a second-floor balcony, Howard said.

She broke her neck. She was in surgery Tuesday, according to Channel 2.

Lott was arrested in Henry County and charged with aggravated assault with the intent to murder, home invasion, battery, theft and attempted arson. He was denied bond.

“I think he only went back with a can of gasoline and with a knife,” Howard told Channel 2. “His intent was to take her life.”

Lott had been released from jail in September after an alleged attack on his ex. Four days later, he attacked her again, police said, and he was arrested and charged with a felony. Despite the district attorney’s office’s request not to give Lott bond when he was indicted Oct. 7, he was released again, Howard said.

Lott is scheduled to appear in court Nov. 29.
