A 71-year-old man was killed early Wednesday by a man who said he was forced to shoot in self-defense, Atlanta police said.

Investigators believe the two men got into an argument outside the Family Dollar on Joseph Lowery Boulevard before shots were fired. The shooter, Maurice Brooks, said the older man fired first, grazing him in the head, Channel 2 Action News reported.

Brooks told police he wrestled the man to the ground, took his gun and shot him at least four times. The older man died at the scene, according to police. His name was not released early Wednesday afternoon pending notification of family members, the Fulton County Medical Examiner’s Office said.

“Further investigation and witness statements corroborate Brooks’ statement that he shot the decedent in self defense,” Officer Kim Jones said in an emailed statement.

No charges had been filed Wednesday afternoon.
