Man charged with killing 83-year-old woman in crosswalk

A Cherokee County man was free on bond Tuesday a month after allegedly striking and killing an 83-year-old woman attempting to cross the street.

Brian Robert Marcus was charged with vehicular homicide in the second degree and striking a pedestrian, both misdemeanor charges, Cobb County jail records showed. Marcus, who lives in Woodstock, surrendered Monday morning and was released early Tuesday on $25,000 bond, according to booking records.

On Sept. 9, Katie Swinehamer was in a crosswalk on George Busbee Parkway at the intersection with Frey Road, near Kennesaw, when she was hit by a Chevrolet Avalanche, Officer Alicia Chilton with Cobb police previously said. Investigators believe Marcus, 52, was making a left turn from Frey Road onto George Busbee Parkway when he hit Swinehamer, Chilton said.

Marcus was not injured in the collision, which happened shortly before 8 a.m. Swinehamer was taken to WellStar Kennestone Hospital in critical condition, police said. She died later that afternoon.
