A DeKalb County judge dismissed charges against a man who was accused of raping a woman in Brookhaven in April.

Roberto Gaona-Pina, 39, was arrested in Opelika, Ala., in May for allegedly attacking a woman who was walking along Buford Highway on April 24.

Channel 2 Action News reported Thursday that the judge dropped all charges against Gaona-Pina because the woman has told conflicting stories about the incident.

Brookhaven police said Gaona-Pina was charged with rape and aggravated assault in connection with an attack of a woman along Buford Highway near North Cliff Valley Way. They said the woman reportedly was hit in the face repeatedly and forcibly raped after being pulled into the woods.

According to police, there are other accusers, but there is not enough evidence to keep Gaona-Pina in custody.
