At the center of the lawsuit is cellphone camera footage that appears to show Kenton County Deputy Sheriff Kevin Sumner, a school resource officer, restraining an 8-year-old boy with handcuffs.
According to the Washington Post, the boy – identified as "S.R." – refused to sit down during the November 2014 incident. Sumner said the boy "attempted to strike [him] with his elbow." That's when Sumner reportedly put the cuffs around the child's biceps.
In the video, the boy cries and asks the deputy to take off the cuffs. The deputy tells the boy he will take them off, but only if the boy agrees to stop kicking and hitting him.
The lawsuit goes on to say that the boy suffers from ADHD and has a history of trauma.
The lawsuit also accuses Sumner of handcuffing another child, a 9-year-old girl identified as "L.G.," twice in October 2014. In the first incident, the girl, who also has ADHD, reportedly refused to follow instructions and was sent to an "isolation room," according to the Post. She was handcuffed after she tried to exit the room, the complaint says. In the second incident, she reportedly was handcuffed after she ran away from Sumner.
