Alysson Pinto-Chaumana was with her mother around 11 a.m. when they walked by the fence, which consists of large marble banisters with a stone ledge at the top, WNBC reported.

Pinto-Chaumana pulled on one of the heavy bollards, and the fence fell on her, causing head trauma. Bystanders flagged a passing ambulance, which took the child to a hospital, where she was pronounced dead.

The Department of Buildings cited the owner for failure to maintain the property, WNBC reported. The owner was ordered to remove the fence. The sidewalk in front of the remaining portion of fence is closed until the fence is taken down.

The owner spent $40,000 for a contractor to install the 3-foot-tall by 6-foot-long fence, WNBC reported.

There were no previous violations at the property.
