With the potential announcement of its latest iPhone next week, Apple's current must-have device may land the tech giant in court.
Consumers have filed a class-action lawsuit against the company after more cases of "Touch Disease" in the iPhone 6 have come to light, Reuters reported.
Todd Cleary, Jun Bai and Thomas Davidson are the plaintiffs, accusing Apple of fraud and violating California's consumer protection laws.
The men claim in the suit that Apple knew of the defect and did not use a metal shield to protect parts of the phone, like designers did in the iPhone 5.
"Touch Disease" starts after a flickering gray bar appears on top of touchscreens. It makes the screen unresponsive, Reuters reported.
Apple sold more than 166 million iPhones with sales totaling more than $108.5 billion this year.
The case is Davidson et al v. Apple Inc and was filed in U.S.District Court, Northern District of California.
The defect was first reported by ifixit.org.
Apple has not responded to multiple media outlets' requests for a comment.
The suit is asking for unspecified damages, an order for Apple to fix, recall or replace the iPhones and an extension of "applicable warranties to a reasonable period of time," CBS News reported.
