Teen driver charged in Cobb crash that killed motorcyclist

A teenager has been charged in connection with a two-vehicle crash that killed a motorcyclist in Cobb County.

Rachel Tyre, 17, of Acworth, is charged with one count each of homicide by vehicle in the second degree and failure to yield while turning left, both of which are misdemeanors, according to an arrest warrant obtained by Cobb County police.

Kennesaw resident Marco Malvaez, 25, died in the crash reported just before 8 a.m. Oct. 14 on Cobb Parkway at Black Acre Trail in Acworth. According to Cobb police, a blue 2007 Mercedes ML350 was traveling northbound on Cobb Parkway while a black 2007 Honda CBR1000 was going southbound.

Tyre, the driver of the Mercedes, proceeded to turn left on Black Acre Trail and “entered the path of the motorcycle, which was approaching the intersection so closely as to constitute an immediate hazard,” according to the arrest warrant.

The motorcycle, which was operated by Malvaez, crashed into the Mercedes, Cobb police said. He was pronounced dead at the scene of the crash.

Tyre was not injured in the crash. She was booked into the Cobb County Jail on Nov. 8 and was released the same day.
