Snellville city council members voted Monday to appeal Gwinnett Superior Court Judge Warren Davis’ ruling stating the city will pay $80,000 of Mayor Kelly Kautz’s legal fees. Davis ruled last month to cut the mayor’s $220,000-plus request to cover legal expenses for her three-member attorney team. Mayor Kautz was the only opposing vote to authorize attorney Kevin Tallant to start the process of appeal at a cost of $20,000.
The legal fees in debate stem from lawsuits filed by the mayor against the city council, city manager and city attorney. Council members claimed the mayor’s legal fees should not be reimbursed by the city since the suit ended in a settlement. In the ruling, Judge Davis decided Kautz was entitled to have her fees paid just as council members had the city pay their $115,000 bill from City Attorney Tony Powell’s team.
