After a constitutional challenge, the Smyrna City Council voted 5-2 recently to rezone 5.61 acres for the development of 14 single-family houses at 3744 Plumcrest Road.

Applicant and owner Sean Tintle will need to abide by 34 regulations, especially regarding buffers and fencing.

Against the development of 2.6 units per acre were Councilwomen Andrea Blustein and Susan Wilkinson.

In support were Councilmen Ron Fennel, Derek Norton, Doug Stoner and Charles Welch and Councilwoman Teri Anulewicz.

This item was denied 4-3 by Council last year when Tintle requested one extra house for a total of 15.

Appealing the decision, Tintle received approval from the Cobb County Superior Court for a mandatory dispute resolution with Smyrna Mayor Max Bacon and Council, resulting in Monday’s favorable outcome for Tintle.
