City of Marietta leaders have taken the first step to enact a smoking ban around the downtown area.

The City Council on Feb. 12 approved the first reading of an ordinance that would ban smoking on public property such as streets, alleyways and sidewalks in a proposed No Smoking District.

“Any private property, including outdoor seating at restaurants, would be regulated by state law, which prohibits smoking if minors are allowed to be served,” said Rusty Roth, the city’s development services director.

The proposed northern boundary includes Polk Street between North Marietta Parkway and Lemon Street. The eastern boundary includes Cherokee and Atlanta streets from Polk Street to just past Waverly Way, Roswell Street from South Park Square to Waddell Street, Waddell from Roswell to Anderson streets and Anderson from Waddell to Atlanta.

For the southern boundary, the city has included Waverly Way from Atlanta Street to the Mountain to River Trail. The southern boundary will connect with the western line along the trail from Waverly Way to Whitlock Avenue. The boundary then runs west on Whitlock to North North Marietta Parkway where it will go north to Polk Street.

Roth said the district includes the public property around Marietta Square Market.

Marietta leaders also approved the first reading of an accompanying ordinance that would also ban smoking in spaces restaurants lease from the city to provide outdoor seating on sidewalks to customers.

The second and final reading for both ordinances will be held at the Council’s March 11 meeting.
