A man who police said was seen viewing apparent pornography on his laptop computer at a McDonald’s restaurant in Roswell was in custody Tuesday night, charged with obstruction after he allegedly tried to run away from officers.
Brent Merrill Kellogg Jr., a convicted sex offender, could face additional charges, depending on what investigators find on his computer, police told Channel 2 Action News.
The incident happened about 1:30 p.m. Monday at the McDonald’s at 591 Holcomb Bridge Road, according to a Roswell Police Department incident report.
A customer complained to the restaurant's manager about what Kellogg allegedly was doing, and the manager walked over and stood behind the man as he sat beneath a television set in the dining area.
The manager, police said, “was able to clearly see over his shoulder that the customer was viewing an obscene photograph” of a partially naked young girl.
“There were a lot of people there at the McDonald’s – there were about 20 people in the dining room – and anybody could have walked by and seen that,” Roswell police spokeswoman Officer Lisa Holland told Channel 2.
The incident report noted at least two children under the age of 5 who could have seen the images. Another witness was an off-duty Fulton County Sheriff’s deputy, Channel 2 reported.
Somebody called the police. Officers soon arrived.
“They asked him about his computer and what he was doing. While they were talking to him, he was erasing pictures from his computer,” Holland said.
The man then allegedly bolted and ran. He was captured by two officers after a short foot chase.
The 43-year-old Kellogg, a Roswell resident, was charged with obstruction. He is being held in the Roswell lockup on $6,000 bond.
Kellogg also was wanted for failing to register as a sex offender, Channel 2 reported. State Department of Corrections records show he served seven years in a penitentiary on a child molestation conviction out of Henry County and was released in 2005.
Henry County police told Channel 2 the molestation case involved a 4-year-old child, and that Kellogg has been on the run for the past two years.
