Testimony is expected to begin Wednesday  in the second murder trial of Roy McKinney in Fulton County Superior Court.

McKinney was convicted in 2005 of murdering his wife, Shaquilla Weatherspoon. The verdict was thrown out   because the transcript of the trial record disappeared. That entitled McKinney to a new trial in  the largely circumstantial case because no record existed for an appeal.

Court reporter Peggy Malcolm said she left the trial record in an evidence locker when she retired and that other staff  lost it.
