Gwinnett man accused of shooting estranged wife's boyfriend

Less than 48 hours after he was released from jail, a Lilburn man is back in police custody accused of shooting the boyfriend of his estranged wife, Gwinnett police said.

The victim told police he was visiting his girlfriend in the 1300 block of Tree Trail Parkway in unincorporated Norcross on Monday. The man left his girlfriend’s apartment and noticed one of the tires on his vehicle was flat, police said.

As the man was inflating the tire, another man -- later identified as Maxwell Nyetrae -- walked up to the victim and shot him, police said.

Police found the victim lying in the road. He was alert and able to talk to police, authorities said. The man was taken to an area hospital to be treated.

The victim told police that the man who shot him is his girlfriend’s estranged husband.

Nyetrae, who Gwinnett police previously had arrested and charged with aggravated stalking of his estranged wife, was released from jail less than 48 hours before the shooting on a probation violation, police said.

Police arrested Nyetrae at his home Monday night. He was charged with aggravated assault, aggravated battery and possession of a firearm during the commission of a crime, police said.

Nyetrae remains at the Gwinnett County Jail.
