The attorney for the wife of the alleged Dunwoody day care shooter has subpoenaed the victim's widow, Andrea Sneiderman, as part of a suit filed Monday seeking legal separation from her husband of 22 years.

Hemy Neuman moved out of his family's East Cobb home on Oct. 3, roughly six weeks before police say he gunned down 36-year-old Rusty Sneiderman outside Dunwoody Prep. The suit, which claims adultery and cruel treatment, seeks alimony for Ariela Neuman and child support for their 17-year-old daughter, the youngest of the couple's three children.

"Filing a suit for separate maintenance is the best way to protect my client and her children's interests at this time," said Esther Panitch, Ariela Neuman's counsel. "The filing speaks for itself, and I will not comment any further at this time."

The complaint does not, however, name Hemy Neuman's alleged paramour. But it does include a subpoena of "any and all documents, records ... or other tangible evidence of communications" from May 2010 to the present possessed by Andrea Sneiderman that mention her former boss. Her deposition is scheduled for March 24, three days after Neuman is to be questioned by Panitch in DeKalb County Jail.

The DeKalb District Attorney's Office recently secured search warrants of the two colleagues' e-mails and phone records, saying in an affidavit they may have concealed evidence regarding Rusty Sneiderman's death. Andrea Sneiderman and her former boss at GE Energy were in "continuous communication" before and after the Nov. 18 shooting, the affidavit states.

Police have not implicated Sneiderman in her husband’s slaying. Calls to her attorney seeking comment have yet to be returned. The AJC has also reached out to Hemy Neuman's lawyers for a response.

E-mails obtained by the AJC revealed that Andrea Sneiderman and Hemy Neuman traveled together on a business trip to the United Kingdom and another to Colorado. Those correspondences included a detailed itinerary by Neuman on the eve of their U.K. trip, including  plans for a castle tour, dinner cruise and possibly a West End musical.

Roughly two weeks after returning from the U.K. trip, Neuman, 48, moved into a condominium in Buckhead.

The veteran engineer was also friendly with Sneiderman's husband. About three months before the shooting, Andrea Sneiderman arranged for her spouse to have lunch with Neuman, e-mails obtained by the AJC confirm. Hemy Neuman wanted out of GE and sought professional contacts from Rusty Sneiderman, a certified public accountant and entrepreneur who was active in medical charities.

The 36-year-old father of two forwarded Neuman’s resume to potential contacts, referring to him as "my friend," e-mails revealed.

In her only public remarks about the case, Andrea Sneiderman said she was “shocked” to learn of her former supervisor’s arrest, saying she had thought of him as a “friend of our family.”

Neuman has been held without bond in DeKalb Jail since his arrest Jan. 4. He's scheduled for arraignment on April 4.
