When she went into the bathroom Sunday morning, a Cobb County woman spotted a flashing light coming from behind the toilet, she told police.

She decided to investigate the source of the light, and when she did, she found her husband's cell phone, according to an arrest warrant obtained by the AJC. The BlackBerry phone was set to video mode so that it could record those coming into the bathroom of the Smyrna apartment, according to police.

And after checking the recorded footage, the woman found explicit videos of one of her daughters in the bathroom, the warrant states. She then called police.

In an interview with a detective, Jose Antonio Presa Garcia allegedly admitted he recorded his wife's adult daughter as well as juvenile daughter, the warrant states. Sunday wasn't the first time he set up the camera, Garcia said, according to police.

"The accused advised he had also captured nude video of his wife's 13-year-old daughter on several occasions as well," the warrant states.

Garcia, 33, was arrested and charged with felony eavesdropping, according to Cobb County jail records. Garcia was booked initially into the Smyrna city jail before being transferred to the county later Sunday, booking records show.

In addition to the eavesdropping hold, Garcia is being held on an immigration violation, according to jail records. He remained in jail Thursday morning without bond.
