Judge postpones action on Fulton tax lawsuit

A lawsuit seeking to overturn Fulton County’s recent 17 percent property tax increase will live on at least until January.

On Wednesday Cobb County Superior Court Senior Judge G. Grant Brantley postponed until Jan. 5 a hearing on Fulton’s motion to dismiss the lawsuit. Attorney Robert Proctor, whose wife Teresa filed the lawsuit, argued he had not had enough time to review and respond to the county’s motion to dismiss.

Proctor’s is one of two lawsuits seeking to overturn the tax hike. The other, filed by several current and former legislators, also is pending.
