An Alabama man was arrested after an alleged road-rage incident in which he was accused of pulling a gun on an off-duty sheriff’s deputy, Channel 2 Action News reported Wednesday.

Sgt. Lou Mitcham says he was making a U-turn along Old Milton Parkway in Alpharetta when 25-year-old Micah Wolverton nearly cut him off last week. The two men exchanged words and the Alabama man then pulled a gun after accusing the off-duty officer of making an illegal U-turn, Mitcham said.

Wolverton never pointed the gun at him but instead used it “to try and scare me and to put me in fear. It obviously did,” Mitcham told Channel 2.

“He pulled the weapon out, pulled the slide back and put a bullet into the chamber,” Mitcham told Channel 2. “He pointed the gun forward the whole time and had this upset look on his face like he was mad.”

Mitcham called 911 instead of using his own gun to defend himself, noting he didn’t have “probable cause” to shoot since Wolverton never pointed the gun in his direction.

Alpharetta police pulled over Wolverton and his van not far from the scene. Police said they found a loaded Glock pistol on the passenger seat.

Wolverton was charged with simple assault and aggressive driving, Channel 2 reported. He said he merely put the gun on the seat and didn’t try to frighten Mitcham, police said.
