Cell phone pocket dial leads to murder arrest

Restaurant argument started the fight

Scott Simon will have a long time to think about his gaffe.

Simon was furious over a disagreement he had at a Waffle House restaurant when he jostled the phone in his pocket and called 911 without knowing.

A recording was made as Simon went on an anger fueled rant saying he would follow the guy and shoot him at his home.

Someone beat him to it. Nicholas Walker was shot and killed as he was pulling onto a highway in Miami.

Police arrested Simon but in a twist, they don’t think he pulled the trigger. Instead they believe he called someone and made arrangements for the murder.

Simon has been charged with first degree murder

"This is a first for me," Miami police said. "Criminals say crazy things all the time, but I've never seen anyone call a recorded line."
